Welcome to AW-CARDS. These Terms of Service ("Terms") govern your access to and use of the AW-CARDS platform, website, applications, APIs, and related services (collectively, the "Service") operated by AW-CARDS Ltd ("AW-CARDS," "we," "us," or "our"). Please read these Terms carefully before using the Service.
By creating an account, accessing, or using the Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.
If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" refers to both you individually and the organization.
You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
To access certain features of the Service, you must create an account by providing accurate, current, and complete information. You agree to update your information promptly if it changes.
You are solely responsible for maintaining the confidentiality of your account credentials. You agree to immediately notify us of any unauthorized use of your account or any other breach of security. AW-CARDS will not be liable for any loss or damage arising from your failure to protect your account credentials.
Each individual may maintain only one account. We reserve the right to merge or terminate duplicate accounts at our discretion.
AW-CARDS provides an AI-powered digital business card platform that enables users to:
The Service is offered through multiple subscription tiers, including a free plan ("Basic") and paid plans ("Pro," "Amaze"). Each plan has different features, limits, and pricing as described on our pricing page. We reserve the right to modify plan features and pricing with 30 days' advance notice.
Paid plans are billed on a monthly or annual basis as selected during subscription. All fees are quoted in US Dollars unless otherwise stated. Payment is due at the start of each billing cycle. We use third-party payment processors and do not directly store your full payment card details.
Certain paid plans may include a free trial period. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends. No credit card is required to start a free trial.
You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period. Refunds are handled on a case-by-case basis; contact us within 14 days of a charge for consideration. No refunds are issued for partial billing periods.
You may upgrade or downgrade your plan at any time. Upgrades take effect immediately, with prorated charges applied. Downgrades take effect at the start of the next billing cycle. When downgrading, features exclusive to higher-tier plans will become unavailable.

We reserve the right to investigate and take appropriate action against anyone who violates this policy, including removing content, suspending or terminating accounts, and reporting to law enforcement.
The Service, including its design, features, code, AI models, templates, themes, graphics, logos, and all related intellectual property, is owned by AW-CARDS and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
You retain all ownership rights to the content you create, upload, or display through the Service ("User Content"). By using the Service, you grant AW-CARDS a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting and display purposes), and display your User Content solely as necessary to provide and improve the Service.
Content generated by our AI tools (bios, summaries, design suggestions) is provided for your use as part of the Service. You own the final content as published on your card. We do not claim ownership of AI-generated content created for your card. However, we may use anonymized, aggregated patterns from AI interactions to improve the Service.
If you provide feedback, suggestions, or ideas about the Service, you grant us an unrestricted, perpetual, irrevocable, royalty-free license to use such feedback for any purpose without obligation to you.
You are solely responsible for all User Content you publish through the Service. You represent and warrant that you have all necessary rights and permissions to use and share such content, and that your content does not infringe any third party's intellectual property or other rights.
We reserve the right (but are not obligated) to review, monitor, and remove User Content that violates these Terms or is otherwise objectionable, at our sole discretion and without prior notice.
When you publish a digital business card, the information on that card becomes publicly accessible via its unique URL. You are responsible for ensuring you only share information you intend to be public. You may unpublish your card at any time through your account settings.
AW-CARDS may offer NFC-enabled cards, stickers, tags, and other physical products for purchase. These products are designed to work with the AW-CARDS platform to enable tap-to-share functionality.
Physical products are shipped to the address provided at checkout. Delivery timelines are estimates and may vary by location. AW-CARDS is not responsible for delays caused by shipping carriers or customs processing.
Defective NFC products may be returned within 30 days of receipt for replacement or refund. Custom-printed products (with your name, design, or QR code) are non-refundable unless defective. Contact hello@aw-cards.com for return authorization.
NFC physical products require an active AW-CARDS account and a published digital card to function. If your account is terminated or your card is unpublished, the NFC product will no longer link to your card.
The Service may integrate with or contain links to third-party services (e.g., CRM platforms, payment processors, analytics providers). We are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is at your own risk and subject to their respective terms.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We may suspend or discontinue the Service or any features at any time without notice.
AI-generated content (bios, suggestions, scores) is provided for convenience and may contain inaccuracies. You are responsible for reviewing and editing AI-generated content before publishing.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AW-CARDS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; OR (D) ANY BUGS, VIRUSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE SERVICE BY ANY THIRD PARTY.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO AW-CARDS IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
You agree to indemnify, defend, and hold harmless AW-CARDS and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with (a) your access to or use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.
You may terminate your account at any time by deleting it through your account settings or by contacting us. Upon termination, your right to use the Service will immediately cease.
We may suspend or terminate your account at any time, with or without cause, and with or without notice. Causes for termination include, but are not limited to, violation of these Terms, fraudulent or illegal activity, extended inactivity, or upon request by law enforcement.
Upon termination, your published cards will be unpublished, your data will be scheduled for deletion in accordance with our Privacy Policy, and NFC physical products linked to your account will cease to function. Sections of these Terms that by their nature should survive termination shall survive, including intellectual property, limitation of liability, indemnification, and governing law.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and close your account.
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may submit the dispute to binding arbitration in accordance with the rules of the London Court of International Arbitration (LCIA). The arbitration shall take place in London, United Kingdom.
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and AW-CARDS concerning the Service.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
AW-CARDS shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, or internet disruptions.
